These Terms of Service ("Terms") govern your access to and use of Goodly Trials, including the website at goodlytrials.com, the web game at play.goodlytrials.com, and the Steam application (together, the "Service"). The Service is operated by Osborn Design Works ("we," "us," or "our").
By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the consent of a parent or legal guardian who agrees to these Terms.
If you use Discord or Steam to sign in, you must also comply with those services' terms.
2. Accounts
Some parts of the Service require an account. You may sign in with Discord, Steam, or both. You are responsible for activity on your account and for keeping your connected accounts secure.
Display names and avatars may come from Discord or Steam. Do not impersonate others or use a name that is unlawful, misleading, or intended to harass.
We may suspend or close an account if we reasonably believe these Terms have been broken, or if we need to protect the Service or other players.
3. License to use the Service
We grant you a personal, limited, revocable, non-exclusive, non-transferable license to use the Service for your own entertainment, in accordance with these Terms. We and our licensors retain all rights in the Service, including the game, art, audio, text, code, and trademarks.
You may not, except as allowed by law:
- copy, modify, distribute, sell, or reverse engineer the Service;
- use the Service for any commercial purpose without our written permission;
- bypass access controls, rate limits, or technical protections;
- scrape, harvest, or automate access to the Service except through ordinary play;
- remove proprietary notices or claim our work as your own.
4. Purchases, Steam, and virtual items
Paid copies of Goodly Trials and related Steam products (including a demo, if offered) are sold by Valve through Steam. Payment, taxes, billing, and refunds for those purchases are governed by the Steam Subscriber Agreement and Steam's refund policy, not by us directly.
In-game gold, units, gear, progression, ratings, and similar items have no real-world cash value. They are licensed as part of the Service, not sold to you, and may change, reset, or be withdrawn as we update the game. You may not buy, sell, or trade accounts or in-game items for real money.
5. Fair play and conduct
Goodly Trials includes single-player journeys, ranked play, and multiplayer lobbies. You agree not to:
- cheat, exploit bugs, or use unauthorized bots, scripts, or tools;
- interfere with other players' games or with our servers;
- harass, threaten, or abuse other players;
- create extra accounts to gain an unfair advantage in ranked or multiplayer play;
- use the Service for any unlawful purpose.
Lobby names and other player-visible text must not include illegal, hateful, or sexually explicit material, or personal information about someone else.
6. Player content
You keep whatever rights you have in names, lobby titles, and other content you submit. You grant us a worldwide, royalty-free license to host, display, and use that content as needed to operate, improve, and promote the Service.
You are responsible for what you submit. We may remove content that we believe violates these Terms or the law.
7. Open beta and changes
The Service may be offered in open beta or otherwise as a work in progress. Features, balance, availability, and saved progress may change. We may modify, pause, or discontinue any part of the Service at any time.
We may update these Terms. The "Last updated" date at the top will change when we do. Continued use after an update means you accept the revised Terms. If you do not agree, stop using the Service.
8. Third-party services
The Service may link to or rely on third parties, including Discord, Steam, YouTube, and advertising or analytics providers. Those services are governed by their own terms and privacy policies. We are not responsible for them.
9. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that it will meet your expectations.
10. Limitation of liability
To the fullest extent permitted by law, we and our officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service.
Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim or (b) one hundred U.S. dollars (US $100). Some places do not allow certain limits, so parts of this section may not apply to you.
11. Indemnity
You will defend and indemnify us against claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or the law.
12. Termination
You may stop using the Service at any time. We may suspend or end your access if you violate these Terms, if we discontinue the Service, or if we reasonably need to do so for legal or operational reasons. Sections that by their nature should survive (including licenses you granted, disclaimers, limits on liability, and indemnity) will survive.
13. Governing law
These Terms are governed by the laws of the United States, without regard to conflict-of-law rules. If a dispute cannot be resolved informally, the state and federal courts of the United States will have exclusive jurisdiction, except where applicable law gives you a right to bring a claim in your home courts.
If a court finds any part of these Terms unenforceable, the rest will still apply. These Terms are the entire agreement between you and us about the Service and replace any prior agreements on that subject.
